The agreement
These terms are between you and NOON, 2426 Blaisdell ave, Minneapolis, MN 55403. They cover the website, the NOON app, ordering ahead, the NOON Card and the loyalty card. Using any of them means you accept these terms and our privacy policy. You must be at least 13 to have an account.
Ordering ahead
An order is placed when your payment goes through, and we start making it when the counter accepts it. Prices are the ones shown at checkout, in US dollars, tax included where it applies. An unpaid order expires on its own. Once an order is accepted it cannot be changed from the app; come to the counter and we will sort it out. Orders are for pickup at the café during opening hours.
Payment
Card, Apple Pay and Google Pay payments are processed by Stripe. Guests pay by card for each order. Account holders may also pay from their NOON Card. By paying you confirm you are allowed to use the payment method.
The NOON Card
The NOON Card is a stored balance for use at NOON only. Reloads are in the preset amounts shown in the app, up to the balance ceiling shown at reload time. The balance never expires, is not transferable, and is not redeemable for cash except where the law requires it. If a reload is charged but never credited, tell us and we will fix it or refund it. Every reload and spend is recorded so your balance can always be checked against the ledger.
The loyalty card
Every paid order earns one stamp; 10 stamps earn a free drink, and the drink is applied to a later order of your choosing. We may also give a welcome stamp when you create an account and a birthday drink once a year if you have told us your birthday. Stamps and rewards have no cash value, belong to one account, and may be withdrawn if they were earned by mistake or misuse.
Refunds and problems
If something is wrong with your order, tell the counter or email us and we will make it right, usually with a remake or a refund to the way you paid. A refund on an order that used a free drink returns the drink to your card. Refund decisions are ours to make in good faith.
Your account
Keep your sign-in to yourself; you are responsible for orders placed from your account. Give us a real email address so receipts and pickup notices reach you. You may delete your account at any time from the Account screen; see the privacy policy for what that removes and what we must keep.
Fair use
Do not interfere with the service, probe it for weaknesses, create accounts to farm stamps or rewards, or use it for anything unlawful. We may pause or close an account that does, and we will refund any NOON Card balance that was honestly loaded.
The concierge
The in-app concierge is an automated assistant that reads the live menu. It can suggest, describe and explain; it cannot place an order or move money, and its answers are not a promise about ingredients or allergens. For allergies, ask a person at the counter.
Liability
The app and website are provided as they are; we cannot promise they will always be available or error-free. To the extent the law allows, our liability for any claim connected to the service is limited to the amount you paid for the order in question. Nothing here limits rights that the law gives you and that cannot be limited.
Changes and law
We may update these terms; the effective date above moves when we do, and we will say so in the app for anything significant. These terms are governed by the laws of the State of Minnesota. Questions: thenuuncafe.com.
